Terms of Service

These Terms of Service ("Terms") govern your use of the Frame mobile application ("App") and related services provided by Frame ("we", "us", "our"). By using the App, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using Frame, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

Frame is an AI-powered eyewear virtual try-on application that allows you to:

• Create a facial portrait using your device camera
• Browse and import eyewear frames from various sources
• Generate virtual try-on images using AI
• Receive personalized frame recommendations
• Save and share your try-on results

3. Account

You must create an account to use Frame. You are responsible for:

• Providing accurate account information
• Maintaining the security of your account credentials
• All activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Payments

Frame offers subscription plans and in-app purchases through Apple's App Store:

• Subscriptions: Paid subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date
• Gems: Frame uses an in-app currency called "gems" for certain features. Gems are purchased through in-app purchase and are non-refundable
• Free trial: If offered, free trials automatically convert to a paid subscription unless cancelled before the trial ends
• Cancellation: You can manage or cancel your subscription through your Apple ID account settings. Cancellation takes effect at the end of the current billing period
• Refunds: All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with their refund policies

5. Consent to AI Processing

Frame uses artificial intelligence to generate virtual try-on images. By using the try-on feature, you consent to the following:

• Your photos will be securely transmitted to our third-party AI processing partners (Google, fal.ai, and Replicate) for the sole purpose of generating try-on images
• These partners process your images only to produce results and do not retain your images after processing is complete
• Your photos are not used to train AI models

6. User Content

You retain ownership of photos and content you create through the App. By using Frame, you grant us a limited license to process your photos solely for the purpose of providing the virtual try-on service.

You agree not to:

• Upload content that infringes on third-party rights
• Use the App for any unlawful purpose
• Attempt to reverse-engineer or extract our AI models or proprietary technology
• Use automated means to access the service beyond normal app usage
• Upload photos of other people without their consent

7. AI-Generated Content

Try-on images are generated by AI and are approximations. We do not guarantee that virtual try-on results will exactly match how frames look in person. AI-generated results should be used as a reference, not as a definitive representation.

8. Intellectual Property

The App, including its design, code, AI models, and branding, is owned by Frame and protected by intellectual property laws. Eyewear brands and product images belong to their respective owners.

9. Disclaimer of Warranties

Frame is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated results will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, Frame shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to purchasing decisions made based on virtual try-on results.

11. Modifications

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App.

12. Termination

You may stop using Frame at any time and delete your account through the App settings. We reserve the right to terminate or suspend access to the service at our discretion. Upon termination, your right to use the App ceases immediately, but provisions regarding intellectual property, limitation of liability, and governing law survive.

13. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation first.
