Terms of Service

Effective: March 26, 2026

These Terms of Service ("Terms") govern your use of the Frame mobile application ("App") and related services provided by Frame ("we", "us", "our"). By using the App, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using Frame, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

By using Frame, you represent and warrant that you:

• Are at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Will not access the App through automated or non-human means (bots, scrapers, scripts)
• Will not use the App for any unlawful or unauthorized purpose
• Will comply with all applicable laws and regulations

If you do not meet these requirements, you must not use Frame.

3. Description of Service

Frame is an AI-powered eyewear virtual try-on application that allows you to:

• Create a facial portrait using your device camera
• Browse and import eyewear frames from various sources
• Generate virtual try-on images using AI
• Receive personalized frame recommendations
• Save and share your try-on results

4. Account

You must create an account to use Frame. You are responsible for:

• Providing accurate account information
• Maintaining the security of your account credentials
• All activities that occur under your account

5. Subscriptions & Payments

Frame offers subscription plans and in-app purchases through Apple's App Store:

• Subscriptions: Paid subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date
• Gems: Frame uses an in-app currency called "gems" for certain features. Gems are purchased through in-app purchase and are non-refundable
• Free trial: If offered, free trials automatically convert to a paid subscription unless cancelled before the trial ends
• Cancellation: You can manage or cancel your subscription through your Apple ID account settings. Cancellation takes effect at the end of the current billing period
• Refunds: All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with their refund policies
• Refund data sharing: When you make an in-app purchase you agree that, if you later request a refund, we may share information about your purchases and app usage with Apple through our payments processor for refund processing, as described in the Privacy Policy. You can withdraw consent at any time in the app's Settings

6. Consent to AI Processing

Frame uses artificial intelligence to generate virtual try-on images. By using the try-on feature, you consent to the following:

• Your photos will be securely transmitted to our third-party AI processing partners (Google, fal.ai, and Replicate) for the sole purpose of generating try-on images
• These partners process your images only to produce results and do not retain your images after processing is complete
• Your photos are not used to train AI models

7. User Content

You retain ownership of photos and content you create through the App. By using Frame, you grant us a limited license to process your photos solely for the purpose of providing the virtual try-on service.

8. Prohibited Activities

You agree not to engage in any of the following:

• Upload content that infringes on third-party intellectual property rights
• Upload photos of other people without their explicit consent
• Use the App for any unlawful, fraudulent, or harmful purpose
• Attempt to reverse-engineer, decompile, or extract our AI models, source code, or proprietary technology
• Use automated means (bots, scrapers, scripts) to access the service beyond normal app usage
• Flood, overload, or attempt to disrupt our APIs or infrastructure (DDoS or similar attacks)
• Attempt prompt injection, jailbreaking, or any manipulation of AI model behavior
• Circumvent or exploit paywalls, subscription checks, free trial limits, or gem quotas
• Distribute malware, phishing links, or any content that threatens user security or privacy
• Interfere with or disrupt the integrity or performance of the App

9. AI-Generated Content

Try-on images are generated by AI and are approximations. We do not guarantee that virtual try-on results will exactly match how frames look in person. AI-generated results should be used as a reference, not as a definitive representation.

10. Intellectual Property

The App, including its design, code, AI models, and branding, is owned by Frame and protected by intellectual property laws. Eyewear brands and product images belong to their respective owners.

11. Disclaimer of Warranties

Frame is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated results will be accurate.

12. Limitation of Liability

To the maximum extent permitted by law, Frame shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to purchasing decisions made based on virtual try-on results.

13. Indemnification

You agree to indemnify, defend, and hold harmless Frame, its affiliates, and its personnel from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of the App, or your infringement of any third-party rights.

14. Termination

You may stop using Frame at any time and delete your account through the App settings. Upon termination, your right to use the App ceases immediately, but provisions regarding intellectual property, limitation of liability, indemnification, and governing law survive.

Account Suspension & Enforcement

We may immediately suspend or permanently deactivate your account, with or without prior notice, if we reasonably believe you have engaged in any of the following:

• Network attacks: Flooding APIs, orchestrating botnets, or traffic spikes intended to disrupt the service
• Automated access: Any unauthorized automated interaction with the App or API
• AI manipulation: Prompt injection, attempting to extract system instructions, jailbreaking, or tampering with model behavior
• Exploiting vulnerabilities: Circumventing paywalls, subscription checks, trial limits, or gem quotas
• Reverse engineering: Decompiling, disassembling, or extracting AI models or proprietary technology
• Security threats: Distributing malware, phishing, or any activity threatening the security, privacy, or compliance of the service
• Content violations: Uploading content without consent, infringing intellectual property, or using the service for unlawful purposes

Process: In urgent cases (security breaches, safety threats), suspension is immediate. For less severe violations, we may issue a warning giving you 48 hours to remedy the breach. Permanent deactivation leads to data erasure as described in our Privacy Policy. Appeals can be submitted to serartinfo@gmail.com.

15. Modifications

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App.

16. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation first.
